If you work on your notice or are placed on gardening leave (i.e. you are not required to come to work during your notice period), you are generally entitled to regular wages and benefits during your notice period – because you are still employed during that period. These include benefits such as private health insurance and pension contributions. If your employer decides to pay you instead of a termination (known as “PILON”), you may not receive all of your benefits because your contract ends immediately, depending on what is in your employment contract. See below for more information. If you have worked for your employer for a month or more, the legal minimum notice period is one week. You do not have to cancel if you want to leave on the last day of your contract. Some employment contracts may provide for a deduction of the last salary if an employee leaves before the end of his notice period (see below). Your employment relationship may be terminated without notice if “severance pay” is included in your contract. Your employer will pay you instead of giving you a notice period. The two main exceptions to this rule are cases of serious misconduct and the conclusion of a fixed-term employment contract. These rights also apply to trainees, who are usually fixed-term. If you stay with your employer after completing your training, your time as an apprentice counts towards your statutory notice period. If you are not paid in accordance with your legal minimum notice period or contractual notice period, you may have a claim for breach of contract, also known as “wrongful termination”. Payment in lieu of cancellation – or PILON – is a sum of money paid to you as an alternative to your full cancellation. It can be set in the contract as an option for your employer or it can simply be paid to cover possible damages for breach of contract. Remember that the above minimum periods are just that – a “minimum”.

If your employment contract provides for a notice period longer than the minimum notice period, you should be entitled to this notice period within the highest period. If you violate your gardening leave clause, such as by working for a competitor during the gardening holiday, your employer may decide to seek an injunction to prevent you from working. This is more likely if it can be proven that your actions are harming your employer`s business and that compensation would not be a sufficient remedy (for example, if you disclose confidential information to your new employer). The employment contract may contain less favourable conditions during a probationary period than at the end of the probationary period, and notice periods are generally shorter if the employee is on probation. However, regardless of the probationary period, the employer must respect the legal notice period of one week. Employees must be paid as usual during their notice period. Your last salary must cover the notice period itself and include payments in lieu of leave not taken. If the dismissal is due to dismissal, it may also be necessary to pay severance pay.

If your employer doesn`t agree, but you still want to leave early, ask yourself if it would cost money.
